Your Property Rights are on the Public Auction Block

Here we go again with the half-truths, misconceptions and out right fabrications by Don Sorchych in his usual weekly rant of My View Nov. 13, 2013.  He loves to be incensed and makes it his life’s goal to be the neighbor from hell.  If you don’t think so, ask any former neighbor. 

He says he hopes the court will deem my Restraining Order ‘frivolous’.  He is either dreaming or unconscious.  If you have the slightest knowledge of Restraining Orders, you know the petitioner must make the case decisively before the Judge as if it has gone to trial.  If the judge doesn’t think you made your case, you don’t get it. 

And, if you don’t get it approved and it’s denied, you have two chances of getting it later: Little or None.

That’s why Abujbarah’s injunctive relief was not granted and why he’s not likely to prevail. He didn’t even make it to first base.  But dream on Sorchych and Usama because you’ve lost half the battle from the outset.

Sorchych then begins his churlish nonsense about “trails” with the outright falsehood that the Town of Cave Creek is now trying to “placate” me. This, after 12 yrs. of siccing his friend Usama Abujbarah and his Town reports on me.  Don ordered Usama to have the Town investigate me with whatever grief they could dig up at every opportunity. They even set up events to provoke confrontations. Repeatedly, they sent Adam Stein to check every aspect of my permits when I built my house and always at the request of Don Sorchych.  Then they wonder why I defended myself with lawsuits against their constant harassment over the past 10 years. 

The “trail” issue is just one more way of harassing me that was initiated by Sorchych and carried out by Usama before he was fired.  Luckily for Usama, he still has his mole Ian Cordwell in Planning and Zoning feeding him Town information.

Let’s look at the trail issue. Sorchych says the “trail” plans were approved by a public vote in 2005. What is a Trail plan? More importantly, how can the public vote to take private property?

The current Trail General Plan by Cordwell and Muller seizes private property under the guise of being good for the entire community.  Their General Trail Plan goes right through the living room of Mr. and Mrs. Wright, through the barn of Mr. and Mrs. Ferguson and right through the middle of my house!  It’s laden with mistakes and errors but is used as a club for forcing trails onto the private property of law abiding citizens.

You tell me how any Gov’t bureaucrat can simply decide to put a trail or any kind of passage through your property.  But this is what they did.  They used the General Plan as a means of harassment by putting it right through existing homes and structures. And then they tell you it’s a legal General Plan voted on by the public in 2005.  You had better be concerned….very concerned.

Mr. and Mrs. John Q. Public, if you are ignoring this because it “doesn’t affect me”, you better think again.  If they can do it to me, the Wrights and Fergusons, they can and will do it to you. They’ll be after your property next for a hiking, biking, horse or motorcycle trail right across your yard.

The Town Attorney assigned to my TRO case says that they can do precisely that. In a status conference with the judge and attorneys this very week on my Restraining order, I was told by my attorney that the Attorney for the Town (Jeff Murray of Sims, Murray) told Mr. Mahaffy that the Town of Cave Creek has the right to put a trail on every piece of property in the Town. 

If that’s so, no one can sell or buy property without having a trail being designated on every plot, street, driveway or yard, or for that matter right through the middle of your house.

Would you buy a piece of land knowing the Town can designate it a path, hiking, biking, horse or ATV trail?  Would you want the entire public invited to use your property like a public park?  That’s the situation now…Murray, the attorney for Town says they have that right.

This is a serious and immediate property rights issue. The freedom to enjoy your own private property is literally at stake. If you believe the Town and people like Steve LaMar, Ian Cordwell and the Town Management won’t do it to you, you’d better think again. They are doing it to me and you are next.

Forewarned is forearmed.  All it takes is to say “It doesn’t affect me” and your property will be gone and your freedom will be gone with it. It’s that simple. Once the Gov’t decides they can take your property for their purposes and gets by with it, we’re all sunk. Murray says they can do it now. It may be too late already.

Remember this the next time you read about Sorchych, Hoeppner, Terry Smith and Steve LaMar wanting to take private property for trails and then call it for the “Love of Cave Creek”.  I call it the Love of Hypocrisy and the Embrace of Socialism.
