Subject Investigation into Conduct of Former Manager in light of Record Destruction

I will try to be brief and to the point.  In short, I have long felt that the former Manager Usama Abujbarah ran the town poorly, burying the Town in debt to over pay for infrastructure acquisitions and build out new facilities well beyond the community’s needs, among other things.  I, and many informed Cave Creek citizens have also felt it is highly probable, given the lengths at which Abujbarah went to assemble and maintain his power, that in so doing he benefited financially.

Since the only justification would have been suspicions, it seemed imprudent to incur the expense of a forensic audit immediately upon our swearing in. That said, in light of the recent revelation that Abujbarah systematically had public records destroyed, which included the destruction of his email records after his authority as town manager had been stripped, it seems there is now cause for further investigation. His conduct begs the question, what was he trying to hide? Please note, that it is my sincere belief that the destruction of those records is a clear violation of ARS §§ 13-2407, 38-363, and 38-421.  

The public deserves to know the extent to which this community was harmed.  They deserve to know that the Town’s public records were destroyed at Abujbarah’s direction, and to have the opportunity to identify what if any monies went where they should not have when Abujbarah spent upwards of $60,000,000.00 on resources that we did not need and that were promptly left to deteriorate by his administration.  A discussion and perhaps an investigation is particularly relevant considering Abujbarah seems to be the central force behind the recall, having circulated petitions to initiate the recall and nominate challenging candidates, and physically posted signs in support of the recall challengers.

I have taken the liberty to seek out a proposal from one firm who handles forensic audits (attached).  The purpose of forwarding this to you is to initiate a public discussion. By virtue of this email, I am hopeful we can set an agenda item to discuss this situation and set a course, either to pursue an investigation through this firm, research other such service providers, or at minimum make the public aware of where things stand.

On June 12, 2013, former Town Manager Usama Abujbarah had Brian Poore of Phoenix Computer Specialists delete all of Usama’s email as Town Manager of Cave Creek.

It appears that this destruction of the Town’s property was done with the knowledge and consent to the Town’s Clerk, Carrie Dyrek. Typically, when an employee is fired and removed from the company’s premises, a security guard is assigned to the terminated employee to insure that company property, to include computer records, are not taken or destroyed. The Truth wants to know why Usama was allowed to direct Brian Poore to erase all of his email, and why Usama was not supervised in his termination process?

Upon information and belief, destruction of Usama’s email is a felony per A.R.S. §§ 13-2407, 38-363 and 38-421. We surmise that the Town’s Attorneys were aware of these felonies but did nothing about it. The Truth believes that the Town’s Attorneys did nothing about it because Usama’s emails would contain compromising emails to the Town’s Attorneys where the Town’s Attorneys were involved in Usama’s wrong doings.

Usama’s son Nasser, was disbarred from the State Bar of Arizona for stealing from his clients. It appears that Nasser learned how to be a thief from his father. The Sonoran Truth respectfully requests that the Town Council immediately investigate this matter to include how and why the Town’s attorneys would allow Usama Abujbarah to destroy Town records, a felony.

It goes without say that the current Town Manager should consider placing Carrie Dyrek on administrative leave pending an investigation. If Carrie knew of the destruction of Town records, she should be fired and be prosecuted for felonious conduct. The Truth also requests that Town Council consider another law firm or lawyer to represent Cave Creek. And finally, any forensic Audit should go out to open bid.
